This Privacy Policy informs you, in accordance with Articles 13 and 14 of the EU General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés), about the processing of personal data on this website and in the course of our repair services.

2. What data we process

• Contact and repair enquiries: name, email address, phone number, device details, fault description – to handle your enquiry and prepare your quote (Art. 6(1)(b) GDPR).
• Order data: billing address, device serial number/IMEI, repair history, payment data – to perform the repair contract and comply with statutory obligations (Art. 6(1)(b), (c) GDPR).
• Device content: data stored on your device is not read, copied or analysed by us unless strictly necessary for the service you ordered (e.g. data recovery) and you have given your express consent.
• Server log data: IP address (shortened), date, time, page accessed, browser type – to ensure technical security (Art. 6(1)(f) GDPR); deleted after 7 days.
• Cookies: see Section 5 below.

3. Retention periods

Enquiry data is deleted no later than 6 months after the communication ends if no order is placed. Order and invoice data is retained for 10 years in accordance with Article L.123-22 of the French Commercial Code. Backup copies created during data recovery are irreversibly deleted no later than 14 days after handover to the customer.

4. Recipients of the data

Data is shared exclusively with: payment service providers (payment processing), the postal carrier La Poste/Colissimo (mail-in and courier service), our accountants (statutory retention) and our professional liability insurer in the event of a claim. No data is transferred to third countries outside the EU/EEA.

5. Cookies and consent

This website uses strictly necessary cookies (to store your cookie preferences and manage sessions) in accordance with Article 82 of the French Data Protection Act and the CNIL guidelines. Statistics and marketing cookies are only set with your express consent (Art. 6(1)(a) GDPR), which you grant via the cookie banner and may withdraw at any time with future effect via "Cookie Settings" in the footer.

7. Obligation to provide data

Providing your contact and device data is necessary for carrying out a repair order. Without this data we cannot accept the order.

8. No automated decision-making

No profiling or automated decision-making within the meaning of Art. 22 GDPR takes place.

General Terms and Conditions of MobiCare Paris SAS, 45 Rue de Rennes, 75006 Paris (hereinafter the "Provider"). Last updated: 1 July 2026.

Article 1 – Scope

These Terms and Conditions apply to all repair and service contracts between the Provider and its customers. Deviating terms of the customer shall not apply unless the Provider expressly agrees to them in writing.

Article 2 – Conclusion of contract

The prices stated on the website do not constitute a binding offer. By submitting the enquiry form or handing over the device, the customer makes an offer. The contract is concluded upon the Provider's order confirmation in text form or upon commencement of the repair. If the actual repair effort exceeds the quote by more than 10%, the Provider will obtain the customer's approval before continuing.

Article 3 – Quote and diagnosis

Diagnosis and quotes are free of charge, except for the complex water-damage diagnosis involving board opening (€39 incl. VAT), which is fully credited against the repair price if the repair is ordered. If no order is placed, the device is reassembled only at the customer's express request.

Article 4 – Prices and payment

All prices are in euros and include the statutory French VAT of currently 20%. The price stated in the quote is a fixed price including the replacement part and fitting. Payment is due after a successful repair, upon collection, by credit card, Carte Bancaire, PayPal, Apple Pay, Google Pay or in cash; for mail-in repairs by advance invoice or PayPal. Business customers may pay on invoice with 14-day payment terms upon request.

Article 5 – Express service

With the express service (+€29) the Provider guarantees completion within 90 minutes of the start of the repair for screen and battery replacements with parts in stock. If this deadline is exceeded, the express surcharge is waived; no further claims arise.

Article 6 – Data backup

The customer is obliged to perform a complete data backup before handing over the device. The Provider is not liable for data loss occurring despite careful execution of the repair, unless caused by intent or gross negligence. For commissioned data recovery: no recovery, no success fee – only the agreed diagnostic flat rate applies.

Article 7 – Warranty and statutory guarantees

The Provider grants a 12-month commercial warranty on every repair, covering the fitted part and the workmanship. The warranty does not cover new drop, pressure or moisture damage, third-party tampering, or normal wear (e.g. battery capacity). The customer's statutory rights – in particular the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code) – remain unaffected.

Article 8 – Liability

The Provider is liable without limitation in cases of intent and gross negligence, and for injury to life, body or health. In cases of simple negligence, it is liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract, and at most to the current market value of the device. For devices with pre-existing damage (in particular water damage), the Provider gives no functional guarantee beyond the repaired component.

Article 9 – Collection and storage

Repaired devices must be collected within 30 days of the completion notice. After 6 months and two reminders in text form, the Provider is entitled to dispose of the device in accordance with the applicable statutory provisions on uncollected deposits (French Law of 31 December 1903 and Articles R.522-8 et seq. of the Consumer Code).

Article 10 – Mail-in repairs

For mail-in repairs, the Provider bears the transport risk only if the insured Colissimo label provided by the Provider is used. Return shipping is always insured and free of charge for orders of €99 or more; below that a shipping flat rate of €6.90 applies.

Article 11 – Mediation and final provisions

In accordance with Articles L.612-1 et seq. of the French Consumer Code, consumers may refer unresolved disputes free of charge to the mediator CM2C, 49 Rue de Ponthieu, 75008 Paris, https://www.cm2c.net, after first contacting our customer service. These Terms are governed by French law. For consumers, the courts having jurisdiction under the French Code of Civil Procedure apply; for merchants, the Commercial Court of Paris has jurisdiction. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.

Right of withdrawal for consumers

Consumers have the following statutory right of withdrawal for distance contracts and off-premises contracts under Articles L.221-18 et seq. of the French Consumer Code (e.g. orders placed via the website, by email or by phone with mail-in of the device):

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

– of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your communication before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we received notice of your withdrawal. We will carry out the reimbursement using the same means of payment that you used for the initial transaction; in no event will you be charged any fees for this reimbursement. A device already sent in will be returned to you without delay at our expense.

Early expiry of the right of withdrawal

If you have requested that the repair begin during the withdrawal period, you shall pay us, in the event of withdrawal, an amount proportionate to the services already provided up to the time of withdrawal (Article L.221-25 of the French Consumer Code). The right of withdrawal expires once the repair has been performed in full, where you expressly consented to performance beginning before the end of the withdrawal period and acknowledged that you would thereby lose your right of withdrawal.

Cancellation terms for workshop appointments

• Before the repair begins: free cancellation at any time – even if the device has already been dropped off; you get your device back at no cost.
• After the repair begins: the services performed up to the cancellation are charged proportionately; model-specific parts already ordered are charged at cost price if they cannot be used otherwise.
• Express appointments: free cancellation up to 2 hours before the agreed time.

The customer remains free to prove that no expense, or a significantly lower expense, was incurred. Refunds are always made to the original means of payment.
